Purpose of the Policy: This Policy describes how DevConic (hereinafter also “us,” “we”) collects, uses, discloses and otherwise processes the personal data you provide by using the DevConic website, located at https://devconic.com (the “Site”) or the services, rendered through the Site, or any other services of FutureSoft LTD. (the “Service”).
Age Restriction: We require users of the Service to be at least 18 years of age. We do not intend for anyone under the age of 18 to use any of the features or services we offer from the Service and we do not knowingly collect personal data from anyone under the age of 18 – so, please, if you are under 18 do not use the Service. We understand and are committed to respecting the sensitive nature of people’s privacy online. If we find out or suspect you are less than 18 years old – we retain the right to limit, pause or cancel your use of the Service in the manner we may deem feet. If you suspect that a user is under the age of 18, please use the report profile mechanism available through the Service.
When you use the Service, you become a user of the Services and consent to our collection, use, and disclosure of information about you as described in this Privacy Policy.
This Policy is an inalienable part of the Terms of Use of DevConic, located at https://devconic.com/terms&condition, and your consent to the provisions of such Terms includes your consent to the provisions of this Policy, provided however that from time to time we may ask for your separate consent hereto. All the definitions in the Terms mean the same through the text of this Policy, unless the context strictly demands otherwise.
1.PURPOSES OF PROCESSING
As used in this Policy, “personal data” is as defined in the General Data Protection Regulation 2018 and any successor legislation, which includes any information which, either alone or in combination with other information we hold about you, identifies you as an individual, including, for example, your name, email address. We need certain personal data in order to provide you with access to our Service. To process your personal data as outlined below, we rely on the following legal bases:
Contractual Performance: Our processing of personal data is primarily driven by the need to fulfill the contractual obligations between you and us. This involves facilitating your use of the DevConic Service, including creating and managing your DevConic Account. By leveraging your personal data, we ensure that your Account is established, visible to other users, and enables you to engage in the creation and management of development contracts with Freelancers within your Account.
We may also utilize your personal data when we have legitimate interests to do so. This includes activities such as analyzing user interactions with our Service to enhance its functionality and overall user experience. Additionally, we process personal data for administrative purposes, fraud detection, and other legal obligations that arise in the course of providing our Service.
Consent: We may also ask for your consent to use your personal data for specific reasons. You may withdraw your consent at any time by contacting us as set out at the end of this Policy.
2. INFORMATION WE COLLECT AND HOW WE USE IT
When using the Service, it is necessary for you to provide personal data to verify your identity. This may include your first and last name, as well as your email or phone number. As stated in our Terms, when creating your DevConic Account, you are required to provide certain personal data, such as your name and email. Once your Account is created and you gain access to it, you have the ability to input and update any information, including your personal data, within your Account. By providing this information, you confirm that (a) the information you provide is truthful, relevant, and up-to-date, and (b) you have not been convicted of a felony or indictable offense, or any crime involving fraud, and you are not under any police control related to intellectual property fraud.
Please be aware that we do not intend to collect any personal data that may be considered “special” or “sensitive” in certain jurisdictions, such as gender, age, religious beliefs, and political views (“Sensitive Personal Data”). Our data collection practices are focused on obtaining the necessary information to provide our services effectively while respecting your privacy.
We may collect and retain information about you in relation to your usage of the Service. This includes any information you send or share through the Service. The purpose of collecting and processing this information is to enable the functionality of the Service, fulfill your requests on the platform, enhance the quality of the Service, conduct research and analysis, personalize your user experience, track Service usage, market the Service, provide customer support, communicate with you, back up our systems, facilitate disaster recovery, improve the security of the Service, detect and prevent fraud and abuse, estimate and report overall audience size and traffic, and comply with legal obligations. Even if we don’t retain this information for long periods, it is initially transmitted to our servers and stored temporarily for processing purposes.

- Automatically Collected Information: When you access our Site, certain information is collected automatically by our servers. This information, including your personal data, is generated by your browser and is commonly referred to as log data. The collected data may include, but is not limited to, the following: device operating system and version, device model (including a unique device identifier), IP addresses, browser type, referral URLs, language information, the domain from which you accessed the Site, Service signup date, last payment date, deposit balance, and first subscription date. Additionally, WiFi information such as SSID, advertising identifier, requested and referring URLs, and other data related to your use and browsing activities on the Site may be recorded. This personal data is utilized for purposes such as bug diagnosis and fraud detection. We may also receive location data from third-party services or GPS-enabled devices that you have authorized, which enables us to provide you with localized information. Furthermore, this personal data enables us to send you notifications based on your preferences.
- Account Information: When you create your DevConic Account and throughout its existence, we collect and retain the information you provide during the registration process. This may include your name, the name of the business entity you represent (if applicable), and billing information. Please note that certain information provided during the Account setup may be publicly displayed as part of your Account profile. It is important to emphasize that you are only permitted to create an Account for yourself and are strictly prohibited from using the personal data of any other individuals when creating your Account. If you suspect that someone has created an unauthorized account impersonating you or misrepresenting your experience, please contact us immediately at support@devconic.com. We will take prompt action to address the situation.
- Public Content: No public content, which is not belonging to us, is intended for posting on the Site or through the Service.
- Contacts: If you wish to invite others to join DevConic, you have the option to provide us with their contact information. We will temporarily store and process this information on our servers for the purpose of sending out your invitations. It is important to note that any communication we send to the invited individuals will clearly indicate that you have extended the invitation to join DevConic. Additionally, it is your responsibility to ensure that you have lawful access to the personal data of the third parties you provide to us for this purpose.
- Communications: By signing up for a Service Account or utilizing specific features, you are consenting to receive messages from other users of the Site as well as from us. Please note that certain administrative, transactional, or legal messages from us cannot be opted out of. It is important to be aware that if you choose to opt out of receiving messages, you may miss important notifications, and therefore we cannot be held liable for any issues related to the delivery or non-delivery of such notifications. We may track your interactions with the messages you receive, such as whether you have opened, deleted, or forwarded them. In the case of message exchanges with other users through the Service, we may store and process those messages to facilitate their delivery, administer the Services, and provide mediation services. Furthermore, we reserve the right to review and disclose such messages in connection with investigations related to the use of the Service and our efforts to enhance the Service. We will not deliver messages that we deem objectionable, such as spam, fraudulent solicitations, or requests for services that cannot be provided or requested through the Site. If you send or receive messages through the Service using a mobile phone, we may log phone numbers, phone carriers, and the date and time of message processing. Additionally, any information you provide to us through communications, including phone calls, letters, emails, or other electronic messages, may be stored by us. If you are a representative of a business entity, we may contact you using the contact information provided by you, which may be publicly available or on record for your business. Please be aware that our phone calls with you may be monitored and recorded for quality assurance purposes, without any additional notification.
- Activity: As you engage with the Service, we may gather personal data related to your actions within the Service, such as the creation of Contracts within your Account and the progress and outcomes associated with those Contracts. This may encompass activities such as passing, liking, commenting, messaging, blocking, and submitting reports. Additionally, we may collect information regarding your search activity, the screens you access, and the date and time of your visits. The collection of this information enables us to deliver the Service and enhance its quality by refining our recommendation algorithm, identifying and resolving bugs or issues, developing new features, and monitoring for any behavior that violates our Terms of Use. Furthermore, this information is utilized for financial reporting purposes.
- Background information: Please note that we do not perform criminal background checks or identity verification on Service users, nor do we investigate the background of users or their activities, unless explicitly stated otherwise in this Privacy Policy. Therefore, we cannot guarantee the absence of a criminal background for any Service user, including those with whom you may communicate through or as a result of using the Service.

- In the event that DevConic is involved in a merger, sale, acquisition, divestiture, restructuring, dissolution, bankruptcy, or any other change of control or ownership, we may transfer personal data to our parent companies, subsidiaries, joint ventures, affiliates, or other companies under common control. We will ensure that these entities uphold the commitments stated in this Privacy Policy. This transfer of personal data may occur as part of the transaction and in accordance with the terms outlined in this Privacy Policy.
We may investigate and disclose information from or about you in certain circumstances. If we have a good faith belief that it is necessary to comply with legal process and law enforcement instructions and orders, prevent or investigate possible wrongdoing, or protect our rights, reputation, property, or the rights of our users, affiliates, or the public, we may disclose information as required. This includes situations where we receive a search warrant, subpoena, statute, judicial proceeding, or other legal process or law enforcement request.
If you report or complain about content through the Site or a Service result, we may share the details of your complaint with the contributor of that content or the Freelancer involved in the relevant Contract. This allows them to respond to your complaint.
We reserve the right to disclose personal information about Site users or information regarding your use of the Services or websites accessible through the Site for any reason if we believe it is reasonable to do so. This may include sharing information with credit agencies, collection agencies, merchant database agencies, law enforcement, or to comply with laws and regulations. We may also disclose information to identify, contact, or take legal action against someone who may be violating our policies or to protect our company, shareholders, directors, partners, and Site users.
Please note that we do not sell, rent, release, disclose, transfer, or communicate your information to any third party for monetary or other valuable consideration. It is our policy to use and share your personal information only in ways that are related to the purposes described above, and we provide you with the opportunity to opt-out or prohibit unrelated uses of your information.
5. CONTROLLING YOUR PERSONAL DATA AND YOUR RIGHTS

And also any our obligation on sending you notification under this Privacy Policy or Terms&Conditions of the Service shall be considered duly fulfilled immediately after the moment it must be sent – irrespective to the fact it can not be sent due to your opting-out.

6. THIRD-PARTY PAYMENT PROCESSOR
We understand that the security and confidentiality of your payment information is important. When you make a payment through our Service, we utilize a third-party payment processor to handle the transaction. We do not retain any personally identifiable information or financial details such as credit card numbers.
The payment processor, however, may collect and store information about you to facilitate the transaction and provide payment-related services. This may include your name, phone number, address, email, payment information (such as credit card number and expiration date), and any other relevant details necessary to process the transaction. The payment processor may also share this information with third parties as required to carry out the payment processing.

The responsibility for initiating and completing a purchase through the Service lies solely with you, and you should exercise discretion and caution when making any payment transactions.

7. DATA RETENTION AND ACCOUNT DELETION
If You decide to delete your Account on the Site You can ask us to delete it by notifying us at the contact information set out below.
Regardless of the method used to delete your account, please be aware of the following:
Certain information that you provided or posted during the course of Contract proceedings or while using the Services may not be deleted. This information may include data that is discovered and used for business purposes and is necessary for the completion of ongoing Contracts by Freelancers. Such information may be retained for business purposes and cannot be deleted upon request.
If you do not request the deletion of your personal information, we may retain it for the duration of your Account’s existence in the Service, unless prohibited by applicable law. We may retain your information for purposes authorized under this Privacy Policy, such as preventing, investigating, or identifying possible misconduct related to the Service, or to comply with legal obligations.
It is important to note that while our systems are designed to comply with the stated retention periods, there may be technical constraints that prevent the complete deletion of data at all times.
Please consider these factors when requesting the deletion of your personal information or closing your account.
8. CROSS-BORDER DATA TRANSFERS
The sharing of personal data as explained in this Policy may involve the transfer of personal data across border, for instance from the United States to other jurisdictions, where data protection and privacy regulations may not offer the same level of protection. As an opposite example, where the Service allows users to be located in the European Economic Area (“EEA”), their personal data is transferred to countries outside of the EEA. Your personal data we process is stored in the Europe (“EAA”) – in no case it means that it will be shared, as described herein, only within the territory of the Europe. Other users: The Service includes user-generated profiles and interactive messaging services. Please remember that any information that is disclosed in these areas may be seen and copied by other users and you should exercise caution when deciding to disclose your personal data. You remain the only liable for any your activities or posting any messages that may harm or abuse any third party in any manner; and from other side note that due to the specific nature of the Site some other Service users may post some content which can be abusing or inacceptable for you – we do not bear any liability for such content posting, but of course you may contact us with appropriate complaint for which we shall send you a proper answer with no warranty of your complaint settlement or solution.
Third-party websites: The Site, the Service (or any Contract created inside of it) may contain links to other websites. If you choose to visit other websites, we are not responsible for the privacy practices or content of those other websites, and it is your responsibility to review the privacy policies at those websites to confirm that you understand and agree with their policies.

The most current version of the Privacy Policy will govern our collection, use, and disclosure of information about you and will be located here.
